TERMS AND CONDITIONS
These terms and conditions are legally binding.
By placing an order with the website www.oakiture.com either by online or phone you agree to be legally bound by these terms and conditions.
We recommend you do not proceed with your purchase until you have read and agreed with these terms and conditions.
- Product Specifications
1.1 We endeavour to display our products within the website as accurately as possible, however, there is no guarantee the completeness or accuracy of the pictures or photographs that are shown.
We and our suppliers continually develop our products and reserve the right to amend any specification of goods or products without prior notice; this may include adjustment of sizes or detailing. Please contact us by phone or through the general enquiries under “Contact Us” on our website if a small adjustment to size will make an item unusable when it arrives.
1.2 Where our furniture is made from natural wood, no two products will ever be identical and accordingly, appearances may vary. Some woods will have varying degrees of distressing applied; this is intentional and makes each piece totally unique as intended by the craftsmen. We sell only genuine rustic designs; therefore, wood splints, Cracks, knots, nail holes, wood filling, purpose distressing, antiquating, and scratch marks are common. These are intended as part of the manufacturing process; they are not defects. Certain ranges will also have extra distressing applied to make them appear as a dulling or a rubbing effect to the waxed finish.
1.3 All our natural leather products are taken from the finest of hides and will show natural marks and scars. This is high-quality leather and accordingly may not result in uniform colour or textures.
1.4 Oakiture offers a range of furniture of which some may require self-assembly, this is to protect some items during carriage. Instructions will be provided for all items needing assembly. We will not be responsible for damage occurring during the self-assembly process. We recommend that if you are not practically minded you take advantage of our premium assembly service, refer to para 4.1, Please note that, unless they are defective, items requiring assembly cannot be returned after they have been assembled.
1.5 From time to time we have a clearance section on our website. Items purchased from this section may contain items from discontinued ranges or items that have been removed from their packaging. The items may have been handled therefore they may have knocks, scratches, or other defects. The reduced sale price takes into consideration any or all of the defects referred to above.
2. Prices and Discounts
2.1 All prices include VAT (Value added Tax) where appropriate, at the prevailing rate and are subject to any promotional offer or discount. We will not be bound to honour any prices where we have indicated to you subsequently that the prices displayed have been displayed in error. In these cases, a full refund will be given.
2.2 We will not refund the price difference or price match once an order has been placed even if we offer a lower price or discount on the goods on our website after the order has been placed. If an order is cancelled, then re-ordered to the same address than an administration charge of £50 will be charged to that same address.
2.3 From time to time we can offer discounts on some of our products. These discounts are dependent on many things and therefore may vary over time. If you have been given a discount code, you must use it within 48 hours as the codes do change on a regular basis.
Please Note: Discounts will not be available when using 0% finance options. Any order placed on 0% finance will be rejected if there is a discount code applied to it.
3.1 Payment will be taken in full at the time of the order.
3.2 You must pay by credit card, debit card, PayPal or through the finance option offered on our website. The price of any product is the price in place at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products are correct, that the credit or debit card you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit or debit card details before accepting your order.
3.3 We reserve the right to refuse any orders placed by you.
3.4 An additional option of consumer finance may be taken by you subject to status. The contract shall not have been concluded until any documents in connection with that finance that require signatures are returned and completed. We cannot be responsible for any delays to your delivery caused by the late return of the signed finance agreements.
Time of deliveries
4.1 We will give you an expected delivery date when we confirm your order. We will do our best to ensure the goods are delivered by that date, but the date is only intended to be an estimate, and we cannot accept responsibility for any failure to deliver by that date.
4.2 In particular, we cannot be responsible if delays arise out of circumstances beyond our control, including (by way of example only) natural disasters or bad weather, changes in legislation or customs practice, shipping delays, shortage of supplies from our manufacturers, shortage of materials.
4.3 We will notify you when your order leaves our warehouse. It then usually takes between 15 – 25 days for the goods to be delivered to you. We use several different delivery companies to deliver our goods and their exact arrangements for delivery may vary, but the delivery company will contact you by email, phone, or text message at least 48 hours prior to delivery of the goods. Please note: Once the order has been dispatched form our warehouse charges will apply as per Para 4.9 should the order be cancelled while with our contracted delivery team.
4.4 Any changes made to your order may impact on the stipulated delivery date. If we are unable to deliver your entire order on the same day, we have the option to deliver in instalments. We will not charge for this service unless it is at your own request for us to do so in which case, we will charge you at the rates set out in clause 4.7 below.

4.5 Our standard delivery service is free of charge to most parts of England, but deliveries to the following postcodes will incur an additional charge of £30

Standard and Premium Delivery
4.6 Standard delivery is by a 1-man team and carried to a ground floor room of choice only with the exception of small items and garden furniture which are delivered to the door and curb side respectively. Alternatively, you can upgrade to our premium delivery service and have your furniture delivered by a two-man team to a room of choice on the 1st or 2nd floor.
Your Responsibilities for Delivery
4.7 You are responsible for ensuring that there is a safe means of access from the public highway to the point of delivery. You are also responsible for ensuring that there no trip hazards or other furniture or impedimentsthat will hamper delivery to the room of your choice. You are also responsible for ensuring that all wall fixtures, floor coverings or ornaments are removed or protected: we will not be liable for any damage caused by our delivery companies in the course of delivering your furniture.
4.8 If you do not comply with clause 4.5, our delivery company may refuse to deliver the goods: this will be treated as a failed delivery, with the consequences set out in clause 4.9 below.
4.9 If our delivery company is unable to make a delivery because you are unavailable at the stated time, or because you have cancelled the delivery or because we are unable to gain safe and unimpeded access to the premises, we will charge you at the rate charged by our delivery company for that failed delivery, subject to the following maximum charges (which are stated without VAT):

4.10 You have the right to cancel your order after a failed delivery, but we will be entitled to deduct the cost of the failed delivery from any money we refund to you for the cancelled order.
4.11 Refusal to Check goods at the time of delivery, all goods must be examined for defects at the time of delivery. Customers who fail to check goods at the time of delivery will be asked to sign a “Refusal to unpack form” at the time of delivery. This will waive your rights to hold either the delivery company or Oakiture responsible for damages.
5. Returns, Refunds and Your Right to Cancel
5.1 Your rights to cancel if you change your mind If you are a consumer (i.e. you are not buying the product(s) in the course of your business) then you have the right to cancel your order at any time up to 14 days after delivery without giving any reason. If you want to cancel your order because you have changed your mind, please contact us by phone or [through the general enquiries section under “Contact Us” on our website. The cancellation period will expire after 14 days from the delivery date. After 14 days have expired, we will not accept returns of any goods unless faulty or not as described.
You cannot return goods to us (whether under clause 5.1 above or because they are defective)
- if they have been assembled by you or a third party;
- unless they are returned in their original packaging.
You cannot return a mattress once the packaging has been opened.
5.3 Your right to cancel does not apply to goods that have been made or altered specifically at your request.
5.4 PLEASE MAKE SURE you are happy with your goods before you start to assemble them and PLEASE REMEMBER to keep all original packaging as intact as possible until you are sure you do not need to return the goods.
5.5 Defective Goods
For these purposes, goods are “defective” if they do not work or are not of satisfactory quality as a result of defects in materials or workmanship or as a result of there having been damaged prior to delivery to you.
5.6 If you think goods may have been damaged in the course of delivery to you (e.g. because the packaging is damaged) you must notify the delivery driver immediately or notify us immediately by phoning us [or using the general enquiries section under “Contact Us” on our website.]
5.7 If you find that goods are damaged or defective when you remove the packaging, you must notify us within 48 hours of discovering the defect and within 2 days after delivery of the goods. You can notify us by phoning us or by using the general enquiries section under “Contact Us” on our website. You should send us photographs of the damaged or defective part of the goods.
5.8 Each case is reviewed within its own merits, if we accept your claim, we will remedy the situation by way of repair, allowance, replacement or refund. We will not be reliable for any damage or loss resulting from repairs attempted by you or third parties. Refunds will only be processed once the item has been returned to us or to our delivery company.
5.9 All items of furniture are purchased as individual items and as such we will only refund and replace any items that are defective or damaged. You are not entitled to reject other items purchased together with the damaged or defective item. If the replacement items are not available, we will refund the purchase price or offer as a similar item from another range which we believe compliments the other items you have purchased.
5.10 Returning Goods
Except where goods are faulty or not as described, you will have to bear the direct cost of returning the goods to us. Please return Items to Oakiture ADDRESS. Appointments will be required to gain access. If you would like us to collect the items from you, then you agree that we may charge you for the cost of collection calculated as set out in clause 4.7.
5.11 Please note the largest item will always be considered the first item and any smaller items will make up the balance of the fees listed in clause 4.7.
We will refund any money due to you by credit to your bank account (or credit card where appropriate) within 7 days after you cancel the contract and return the goods to us. Please note that it may take up to 30 days for the refund to show on your bank statement.
5.13 Return of items subject to credit. The purchase of any goods on credit terms is made concurrently with a finance agreement between you and the finance company. In the event that you seek to return items that have been purchased under a finance agreement, we will return to the finance company any and all sums advanced by the finance company in relation to their agreement with you once we have received the returned items (if applicable) plus any return fees.
5.14 We will not refund the cost of any services already delivered, including the cost of premium delivery or any charge for assembly of furniture. We reserve the right to deduct the cost of any failed delivery (calculated as set out in clause 4.7) from any sums refunded.

7. Applicable Law and Jurisdiction
7.1 These terms and conditions shall be interpreted and construed in accordance with English law. In the event of a dispute between us, the courts of England and Wales will have exclusive jurisdiction to deal with that dispute.
